Acceptable Use Policy
This Acceptable Use Policy (“AUP”) is part of the wapio Terms of Service and describes rules for using WhatsApp messaging and related features. It is written to align with Meta’s WhatsApp Business Messaging Policy and Tech Provider expectations. Last updated: 10 August 2026.
1. Purpose
Techspence Private Limited provides wapio so businesses can use Meta’s WhatsApp Cloud API responsibly. Abuse harms End Users, Clients, and our ability to remain a Meta Tech Provider. Violations may result in suspension, termination, or reporting to Meta.
2. Opt-in and consent (mandatory)
Before messaging people on WhatsApp, Clients must ensure:
- The person has provided their mobile phone number to the business
- The business has received opt-in permission confirming the person wishes to receive subsequent messages or calls from that business
- The opt-in clearly states that the person is opting in to receive communication from the business and clearly states the business’s name
- The method of opt-in complies with all applicable local laws (including India’s DPDP Act where relevant)
Per Meta’s November 2024 messaging policy update, opt-in may be general (not WhatsApp-specific) if it still meets Meta’s requirements and local law. Where local law requires channel-specific disclosure (or naming WhatsApp / Meta as a recipient), Clients must comply with the stricter standard.
Supported opt-in channels include website forms, SMS, IVR, in-person / paper, app flows, and other methods that meet the above. Clients should retain records of consent (timestamp, source, wording, phone number).
3. Opt-out
Clients must provide clear ways for people to stop receiving categories of messages and must honour opt-out requests promptly. Blocking, reporting, or “STOP”-type signals must be respected in accordance with Meta tooling and policy.
4. Message categories and expectations
- Use approved message templates for business-initiated conversations outside the customer care window
- Do not mis-categorise templates to evade pricing or policy rules
- Keep quality high; sustained low quality may trigger Meta rate limits or enforcement
- Transactional and marketing content must match user expectations set at opt-in
5. Prohibited content and verticals
Clients must not use wapio / WhatsApp to send or facilitate:
- Illegal products or services under Indian or applicable local law
- Content banned by WhatsApp Business / Commerce policies (including prohibited adult, weapons, or other restricted categories as Meta defines from time to time)
- Hate speech, harassment, threats, or exploitation of minors
- Malware, phishing, social engineering, or credential harvesting
- Deceptive multi-level marketing, fake engagement, or impersonation
- Spam or bulk unsolicited messaging
Clients must continually review Meta’s current WhatsApp Business Messaging Policy and related commerce rules, which may change.
6. Data use restrictions
- Do not use Business Solution Data to build or augment profiles on individual WhatsApp users beyond what is needed for your own message threads and customer service
- Do not sell or redistribute Business Solution Data
- Do not use Business Solution Data to train general AI models in violation of WhatsApp Business Solution Terms
- Do not attempt to scrape, harvest, or re-identify End Users beyond authorised business communications
7. Technical integrity
- Do not probe, load-test abusively, or disrupt Meta or wapio systems
- Protect API keys, webhook secrets, and agent accounts
- Do not bypass messaging limits, blocks, or security controls
- Keep webhook endpoints HTTPS-secured and validate signatures
8. Government and regulated use
Government entities and regulated industries must use WhatsApp only in ways Meta permits (including any requirement to work through authorised solution channels). Clients are responsible for sector-specific compliance (e.g., financial, healthcare).
9. Enforcement
We may investigate suspected violations, request proof of opt-in, suspend messaging features, terminate accounts, preserve logs for investigations, and cooperate with Meta or law enforcement where appropriate.
